评分之前上课读完the Buffalo disaster老师就推荐了这本,说不是每一个案子都伸张正义了,这个就输的很惨,破产的主角还来我们学校演讲过。。。。终于抽空读了写的真好。。。
评分3年前想读的。教授帮忙 要求punitive damage 有种神来之笔,可惜最后案子因为原告经济不足以支持,只能以和解告终。原告律师自己贴钱的巨大风险,甚至要向信用卡公司借高利贷,最后还搞到自己破产。法官读起来一开始还不偏不倚,但后来被写得像一面倒支持好朋友,处处针对原告了。关键的一点是法官用“自己的判断”,只对Grace的污染行为加以确认,直接打消了对另一家的污染行为指控(即使陪审团不同意),而另一家在审判过程中隐瞒了不少对自己有害的证据,之后上诉法院也只是把案子发回同一个法官审判,这就进入了一种死循环之中。
评分4.5。本学期完成的第二本阅读教材。最后那段真是。。。一个人是要被什么摧毁的过程中才有可能意识到存在的真相的。被摧毁而未消亡,就有可能抵达真正的自己。很残酷。所幸他游向深海之后,最后还是回来了。
评分漫长的诉讼
下半年入P大国际法学院,这本是导师推荐的入学前需要读完的第一本书,算是对美国法律体系是怎么运作的初步印象吧,导师强调的还是解决问题的思维而不是法律条文。另外的一本的是To Kill A Mockingbird.
评分书看完的一些感受: 1、在法律保障基本人权方面,我们与美国还差50年的距离。1970年代的美国民事诉讼,原被告的证人都可以在人身安全得到保障的前提下、没有负担地参与诉讼,在法院工作人员的见证下,接受双方询问,以期尽可能接近事实真相,不会被对方威胁、不用担心被报复。...
